IN THE NEWS 82 @dayspamagazine • March 2019 © GETTY IMAGES NEW HOPE FOR HEMP In December, congress approved the Agricultural Improvement Act of 2018, also known as the Farm Bill, which includes language to fi nally legalize industrial hemp—and therefore products containing hemp-derived cannabidiol (CBD)—at the federal level. Consumers were already able to purchase CBD products in the 47 states where it was legal, but this new legislation allows all states to decide whether or not to okay the sale of CBD products made from hemp within their borders. It also changes how marijuana is defi ned in the Controlled Substances Act, so that it doesn't include hemp. The U.S. Food and Drug Administration (FDA) was quick to issue a statement noting that they still consider CBD foods and dietar y supplements to be illegal "regardless of whether the substances are hemp-derived." More specifi cally, they noted, "the FDA requires a cannabis product (hemp-derived or other wise) that is marketed with a claim of therapeutic benefi t, or with any other disease claim, to be approved by the FDA for its intended use before it may be introduced into interstate commerce." So, while the future is looking up for CBD, it makes sense for businesses—including spas—to tread carefully when marketing and selling products and ser vices that utilize the compound.
