The Institute for Justice, which describes itself as a "merry band of libertarian litigators," has assessed the situation very accurately: One danger of occupa- tional licensing regimes is that, once established, they take on a life of their own. Once licensees enjoy the benefi ts of limiting compe- tition, they become a per- sistent lobby for keeping li- censes on the books and for expanding them to encom- pass previously unlicensed practices. And because regu- latory boards established to oversee the licensing pro- cess are typically made up of current practitioners and funded by licensees' dues, they have tremendous incen- tives to adopt and enforce a broad interpretation of a license's scope. All too often the result is that new busi- ness models or techniques are choked off as would-be innovators are forced to un- dergo costly and irrelevant training or testing or are effectively shut down with threats of fi nes, injunctions or even criminal prosecution. In Navajo culture, there's a belief in a being called "the skin walker" or yee naaldlooshii, literally meaning "with it, he goes on all fours." Most of us know this better as "shape shifting"—the ability to turn oneself into any being one chooses. The spa industry has been fi ghting against shape shifters for years, in the form of associated professions in the health and beauty sectors that at- tempt to reserve ever-larger pieces of the economic pie for themselves. It's no wonder the Supreme Court agreed to hear the dentists' case. The power of the various professions and private trade as- sociations to shape-shift into the guise of state regulatory bodies is at stake, with potentially far-reach- ing consequences. Such groups will most certainly fi ght not to relin- quish their abilities to use the coer- cive power of government in their favor, to protect their interests and to feather their own nests.
