MANAGEMENT WORKSHOP 92 DAYSPA | MAY 2015 dayspamagazine.com/freeinfo • Use FreeInfo #50 to meet the employer mandate. (But even if you're one of them, don't stop reading now: there's still something that applies to you.) For employers of 50-99 full-time em- ployees, nothing is required this year. But those employers must offer health- care coverage to 95% of full-time em- ployees, and their dependents up to the age of 26, by January 1, 2016. For employers of 100 or more full- timers, it's a different story. They must have already offered coverage to 70% of their full-time employees, and their dependents up to the age of 26, by January 1, 2015—a deadline that has passed. So, spa owners who have a number of locations incorporated as separate entities should look at this carefully. If several spas have a common owner, the spas are combined to determine the number of employ- ees and whether the mandate applies. However, if any penalties apply, these would fall on the individ- ual spa entities. About those penalties: For an employer subject to the mandate, the penalty is $2,000 per employee, but the fi rst 30 employees are excluded. Say that on January 1, 2015, Acme Spas had 110 employees. It did not offer coverage and 37 of its employees received a federal premium subsidy for coverage they found in HHS CALCULATOR To calculate "minimum value" as defi ned by the Affordable Care Act, you can download the spreadsheet provided by The Department of Health and Human Services by going to cms.gov and typing "Minimum Value Calculator" into the search box. Then do the following: • Click on the fi rst link on the results page, entitled Minimum Value Calculator. • Save the fi le rather than open it. (If you try to open it, you will wait forever.) • You may see the message, "This fi le originated from an Internet connection and might be unsafe." (I know, if you can't trust Health and Human Services, who can you trust, but there it is.) • Be patient with yourself. The spreadsheet might look daunting but, as with most things in life, it isn't complicated if you take some time and read the User Guide.
